Service Agreement

Website Distance Sales Agreement
Pursuant to the 'Regulation on the implementation procedures and principles of distance contracts' published in the Official Gazette dated 13.06.2003 and numbered 25137, it is obligatory to make a contract for sales made over the internet. The contract details are as follows.
 
Website Distance Sales Contract
1- Parties
 The service provider www.bodrumtaxis.com will be referred to as "Agent".
 
The person whose name and surname is specified in the reservation and/or the persons he/she represents will be referred to as "Consumer".
2- Subject
This contract is made between the Consumer and the Agency.
 
It is arranged for service sales made in written, visual, telephone and electronic media in accordance with the services sold by the agency, the qualifications and sales conditions of which are specified below, and covers the rights and obligations of the parties.
 
It covers the transfer, tour and car allocation services purchased by the Consumer from the Agency's website, the qualifications of the purchased service are specified in the Website Distance Sales Agreement and "Terms and Conditions" pages and the service fee is specified in the reservation and confirmation form sent to the e-mail address.
3- Duration of the Agreement
This contract shall enter into force on the date of confirmation of the reservation by the Agency and shall terminate automatically when the service received by the Consumer is completed if no dispute arises. In case of dispute, this contractual relationship will be valid until the final resolution of the dispute.
4- Payment and Invoice Information
In service purchases by credit card, the consumer is obliged to pay the service fee at the time of booking.
K.D.V. is included in the prices specified in the service fee.
Making the reservation and payment; It means the acceptance of the provisions specified in the Agency's Website Distance Sales Contract and "Terms and Conditions" pages.
Complaints and refund requests must be submitted to us until 14 (fourteen) days after the date of service.
The invoice issuance period for the purchased service is 7 days including the date of purchase, provided that the month is not skipped in accordance with the V.U.K.
 
The agency will use the information provided in the reservation form to document the invoices to be sent to the consumer.
Upon request, the invoice will be sent by cargo to the address specified by the consumer in the reservation form.
For payments made with Paypal, the transaction (commission) fee charged by Paypal is added to the service fee on the Paypal payment page and the commission amount belongs to the customer.
In Paypal returns, the transaction (commission) fee charged by Paypal is deducted from the Paypal payment service fee and the commission amount belongs to the customer.
 
In credit card payments, in the installment payment options selected by the customer, the maturity difference determined by the relevant bank or payment systems is added to the service fee and is automatically specified in the installment payment table.
 
The costs arising from the cancellation and return of credit card payments made to the bank's POS system or the company providing payment systems services are deducted from the amount to be refunded at the expense of the customer.
In the refunds of payments made by bank transfer, the transaction fee charged by the bank is deducted from the service fee and the transaction fee belongs to the customer.
For some vehicles on our website, only prepayment may be required as a payment option.
The prepaid vehicles specified on the reservation page of our website are required to be booked 72 hours in advance based on Turkey local time, and if the reservation is made, the time limitation is deemed to be accepted.
For requests that will occur under 72 hours of the specified vehicles, pre-compliance must be obtained by contacting us.
In some destinations on our website, only prepayment may be required as a payment option.
In bank transfers made from abroad, there may be commissions deducted by the sender due to reasons arising from financial agreements between countries or the commission policy of the sending bank or correspondent bank.
Commission deductions and responsibility arising from the bank to which the money transfer will be made belong to the sender.
To avoid such a situation, please get confirmation from your bank.

5- Cancellation and Amendment
When the consumer requests cancellation up to 12 hours before the start of the service, the full amount of the service fee paid will be refunded.
 
If the consumer requests cancellation less than 12 hours before the start of the service, 50% of the one-way service fee will be refunded (if the two-way service fee has been paid, the entire return fee will be refunded).
 
These conditions do not cover promotional services, early booking or discounted reservations.
 
Cancellation provisions are valid for date changes made by the consumer.
 
The Consumer agrees that he/she will comply with the rules of the service contract regarding the service purchased from the Agency; he/she will respect the life, property and peace of third parties, otherwise he/she will not be able to receive the service for just cause and will not have the right to return.
 
After the performance of the service, if the relevant bank or financial institution does not pay the service fee to the Agent due to the unfair or unlawful use of the credit card of the Consumer by unauthorized persons in a way not caused by the fault of the Agent, the Consumer is responsible for the service fee and the damages incurred.
6- General provisions
The agency will try to provide an alternative vehicle as soon as possible as soon as it realizes that it will not be able to carry out your transfer due to mechanical failure, traffic accident, operational disruptions, weather opposition, traffic congestion, terrorist incidents, practices of law enforcement agencies, etc., which will prevent the start or continuation of the service.
 
In the cases we have mentioned above, the refund of the transfer fee for which the payment has been received will be returned to you without interruption and / or in such a case, the price difference arising from the transportation provided by the Consumer with your own means will be paid to the Consumer by the Agency.
 
In the event that the agency does not comply with the contract partially or completely, the articles of TURSAB SCHEDULE shall be applied in the calculation of the compensation to be paid.
7- Enforcement
This contract consists of 7 main articles, and if necessary, it will be issued in 2 copies and signed by the parties, and in disputes arising from the contract, the provisions of the Road Transport Law No. 4925 shall apply.  Bodrum court and execution offices are authorized for disputes arising from this contract.
 
I have declared that I have read and accepted the contract on behalf of myself and/or the persons whose names are written on the reservation form.
 
This declaration is valid even if someone else has executed and/or signed the reservation process instead of myself.
 
As a consumer, I declare that I have read, understood and accepted all of the provisions specified in the Website Distance Sales Contract and "Terms and Conditions" pages issued on our behalf, the responsibility for the accuracy of my information in the reservation form I have sent, the Road Transport Law No. 4925 and the information on the Agency's website.
